Terms of Service

1. Acceptance of Terms & Capacity to Consent

By downloading, installing, or using Tavra ("the Software"), you agree to these Terms of Service. You represent and warrant that you are at least 18 years of age, or the age of legal majority in your jurisdiction, and possess the legal capacity to enter into this agreement. If you do not agree, or do not meet these requirements, do not use the Software.

2. Prohibited Use, Enforcement & Termination

The permissibility of using Tavra is determined by the content you are viewing and the rules governing that content, not by the software environment itself. You agree not to use Tavra in any of the following contexts:

(a) Standardized & Credentialing Exams

Any high-stakes standardized or credentialing examination administered on your personal computer — including but not limited to the SAT, PSAT, AP digital exams, ACT, GRE, TOEFL, GMAT, LSAT, and remotely-proctored professional certifications.

(b) Unauthorized Assessments: Any academic or professional assessment where the administering body prohibits outside tools or AI assistance.

(c) Copyrighted Content: To process, capture, or analyze proprietary exam content, copyrighted test materials, or any content you do not own or lack authorization to use with AI tools.

(d) Academic Dishonesty: To gain an unauthorized advantage in any evaluation where doing so would violate the administering organization's rules.

Enforcement. Tavra enforces the prohibited-use policy through two independent mechanisms applied against a blacklist of prohibited testing applications used to administer high-stakes standardized and credentialing exams. The blacklist includes, without limitation:

  • College Board Bluebook — SAT, PSAT/NMSQT, AP digital exams.
  • ACT Gateway / TestNav — ACT.
  • ETS Test Browser — GRE, TOEFL.

First, Tavra's functionality is architecturally non-operational against the specific window titles and process names of the prohibited applications listed above. This is a property of the code itself rather than a runtime check, and remains in effect regardless of any other condition of the Software.

Second, Tavra additionally performs runtime environmental checks: it scans active process names and window titles, and where a blacklisted process or window is detected, immediately terminates the session and logs the attempt. Purposeful violations result in permanent account ban. This check is environmental only — Tavra does not inject into, read the memory of, or modify any third-party application.

The combined effect is that prohibited applications are protected from Tavra's functionality at two independent points: the underlying code is incapable of operating against those applications, and the runtime check terminates the session on detection. The blacklist is updated at Tavra's sole discretion as new high-stakes testing applications are released.

Termination & Consent. We may suspend, terminate, or ban any account at our sole discretion, without notice or liability. By using Tavra you consent to the scanner as a condition of use and agree that the blacklist is maintained at our sole discretion. You may not disable, circumvent, or interfere with the scanner; doing so is itself a material violation and independent grounds for permanent ban.

3. Description of Service & Intellectual Property

Tavra is an AI-powered accessibility overlay designed to assist users with reading, comprehension, and on-screen content processing across any desktop environment. It operates as an independent display layer that exists only for the user — it does not appear in screen recordings, does not take focus from other applications, and does not affect any other running software. With the exception of superficial environmental checks used strictly to enforce our prohibited use policies, Tavra does not modify, inject into, or interact with the internal processes of any third-party application or browser.

License Grant: Tavra and its developers retain all ownership, copyright, and intellectual property rights in and to the Software. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Software strictly in accordance with these Terms.

4. Intended Use & The "Overlay" Nature

Tavra is designed as an accessibility and productivity tool for users who benefit from on-demand AI assistance while working, reading, or learning. Because Tavra acts as an independent system-wide overlay, it naturally renders over any application currently visible on your screen, including standard web browsers and restricted or locked-down browser configurations.

Legitimate uses include, but are not limited to:

  • Accessibility support — including reading assistance, on-screen text interpretation, contextual summarization, and other supports for users with visual, cognitive, or learning-related needs that benefit from a system-wide AI layer.
  • Translation and language-comprehension assistance for non-native speakers.
  • Assistance with routine homework, coursework, and open-book assignments where external tools are permitted.
  • Reviewing your own uploaded notes, documents, ebooks, or research papers.
  • Researching technical documentation, API references, and reference material while coding or writing.
  • Corporate or organizational training modules.
  • Professional development and continuing education.

5. User Responsibility & Assumption of Risk

You are solely and exclusively responsible for ensuring that your use of Tavra complies with all applicable rules, policies, regulations, and laws. You acknowledge that:

  • Tavra is a general-purpose productivity tool, and the decision of when, where, and on what content to use it rests entirely with you.
  • Tavra and its developers bear no responsibility for any consequences arising from your use of the Software, including but not limited to academic discipline, score cancellation, professional sanctions, copyright infringement claims, or legal liability.

User Warranty of Authorized Use: Each time you initiate a session with Tavra, you affirmatively represent and warrant that (i) you own, control, or have explicit authorization to use AI-assisted tools with all content visible on your screen during that session, (ii) you are not currently sitting for any examination, assessment, or evaluation prohibited under Section 2, and (iii) your use of Tavra in that session does not violate any rule, policy, agreement, or law applicable to you or the content you are viewing. This warranty is renewed automatically with each session.

6. No Affiliation with Third Parties

Tavra is an independent software product. It is not affiliated with, endorsed by, integrated with, or sponsored by any testing organization, browser vendor, proctoring service, or educational institution. Any incidental compatibility with third-party environments arises solely from Tavra's nature as an independent external overlay.

7. Legal Disclaimers & Limitations

Indemnification: You agree to indemnify, defend, and hold harmless Tavra, its developers, officers, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use or misuse of the Software, or your violation of these Terms.

Disclaimer of Warranties: The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: To the fullest extent permitted by law, Tavra and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Software, even if advised of the possibility of such damages.

Dispute Resolution & Binding Arbitration: Please read this section carefully, as it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by arbitration in Delaware before one arbitrator.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures.

Severability: If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

Modifications: We reserve the right to modify these Terms at any time. Continued use after changes are posted constitutes acceptance.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Reporting Misuse: Testing organizations, copyright holders, educational institutions, and proctoring services may report suspected misuse of Tavra to the address above. Tavra reviews all good-faith reports and cooperates with legitimate requests, including expanding the enforcement blacklist described in Section 2 where appropriate. Please include the name of the application or content allegedly involved and any evidence reasonably available to you.
